DEVELOPER Helioslough has made a strong assault on the council's claim that changes of circumstance since the first inquiry justify refusal of planning permission.

The first inspector concluded that the effect on the landscape was not sufficient to defeat the railfreight project, but landscape expert Jonathan Billingsleigh said this morning there had been important changes, such as the widening of the 25 motorway and new housing developments in Park Street.

Under cross-examination, he has admitted the inspector who heard the 2007 inquiry would have been aware of the new developments, and he had no detailed evidence that the motorway widening had a significant impact on views.
