INTRODUCTION OF PARKING CONTROLS IN AGRICOLA PLACE AND IN THE PARKING AREAS RELATING TO CERTAIN HOUSING ESTATES AND OTHER RESIDENTIAL PROPERTIES

INTRODUCTION OF PARKING CONTROLS IN AGRICOLA PLACE AND IN THE PARKING AREAS RELATING TO CERTAIN HOUSING ESTATES AND OTHER RESIDENTIAL PROPERTIES

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Enfield on 9th October 2017 made the Enfield (Off-Street Parking Places) (Housing Estates and Other Residential Properties) Order 2017, the Enfield (On-Street Parking Places) (Housing Estates and Other Residential Properties) Order 2017, the Enfield (Free Parking Places) (Disabled Persons) (No. 7) Order 2017 and the Enfield (Waiting and Loading Restriction) (Amendment No. 141) Order 2017, under sections 6, 35, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended.

2. The general effect of the Orders will be to introduce parking controls in the parking areas relating to the properties specified in items 1 to 4 of the Schedule to this Notice and in the road specified in item 5 of that Schedule. The parking controls will be enforced under the provisions of the Traffic Management Act 2004 which means that Penalty Charge Notices could be issued by the Council's Civil Enforcement Officers to vehicles that contravene the parking controls and vehicles may be towed away, in the same way as on the public highway. The same rights of appeal to an adjudicator will also apply.

3. The parking controls referred to in paragraph 2 above, will operate at all times and as follows -

(a) all the existing parking bays and double yellow lines in the parking areas and road will remain;

(b) new double yellow lines, on which vehicles will be prohibited from waiting at any time, will be introduced in some parts of the parking areas and road;

(c) where an existing parking bay is not currently indicated as being for the use of a particular vehicle, then in future only vehicles displaying the appropriate resident's parking permit for that parking area or road (or a contractor's permit or a staff permit) will be permitted to park in these parking bays;

(d) where an existing parking bay is indicated as being for the use of a disabled person's vehicle, then only a vehicle displaying a disabled person's blue badge will be permitted to use that bay;

(e) where an existing parking bay is indicated as being for the use of motor cycles, then only motor cycles will be permitted to use that bay;

(f) vehicles will have to be parked wholly within the marked parking bays at all times;

(g) resident's parking permits will only be issued to residents living at a property or in the road specified in the Schedule to this Notice, they will be limited to one permit per household and each permit will allow one vehicle to park in the parking area or road where the resident lives;

(h) contractor's parking permits and staff parking permits will only be issued to eligible contractors and Council staff working at properties or in the road specified in the Schedule to this Notice (this will include staff working for Christian Action Housing Association in the case of Dover House and Calais House);

(i) in addition, parking permits will only be issued in respect of passenger vehicles or commercial vehicles/vans that are not more than 2 metres high, or motor cycles and provided the vehicle does not have a SORN made in respect of it;

(j) the charge for a resident's parking permit will be £50 for 1 year, the charge for a contractor's parking permit will be £10 for 1 week and the charge for a staff parking permit will range from £55 for 1 year for a vehicle of 1000cc or less up to £330 for 1 year for a vehicle of 3000cc or more.
4. The Orders, as originally proposed, would have introduced the above parking controls in Warley Road and in the parking area relating to Nos. 109 to 219 (odd numbers, inclusive) and Nos. 229 to 295 (odd numbers inclusive) Bounces Road, London N9, but these parts of the original proposals will not be introduced at this time.

5. Copies of the Orders, which will come into operation on 16th October 2017, and any other relevant documents can be inspected at the Reception Desk, the Civic Centre, Silver Street, Enfield, Middlesex, EN1 3XD during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made.

6. Copies of the Orders may be purchased from Traffic and Transportation, The Civic Centre, Silver Street, Enfield, Middx, EN1 3XD.

7. Any person desiring to question the validity of the Orders or of provisions contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulation made thereunder has not been complied with in relation to the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.
