PLANNING NOTICE HARLOW COUNCIL
TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) (ENGLAND) ORDER 2015 NOTICE OF THE MAKING OF ARTICLE 4(1) DIRECTION WITHOUT IMMEDIATE EFFECT CONCERNING SMALL HOUSES IN MULTIPLE OCCUPATION ('HMOs') AND RELATING TO ALL LAND WITHIN THE ADMINISTRATIVE AREA OF HARLOW COUNCIL
NOTICE IS HEREBY GIVEN that Harlow Council on 26th March 2020 made a Direction under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 ("the Order") which affects all Land within the Administrative Area of Harlow Council and which withdraws permitted development rights as specified below in respect of development comprised within Class L of Part 3 to Schedule 2 of the Order.
The Article 4 Direction applies to all Land within the Administrative Area of Harlow Council and shown, for the purposes of illustration only, edged red on the plan attached hereto.
The Article 4 Direction applies in the affected areas to development that is comprised within Class L(b) of Part 3 to Schedule 2 of the Order, namely:
"Development consisting of a change of use of a building?
(b)from a use falling within Class C3 (dwellinghouses) of the Schedule to the Use Classes Order, to a use falling within Class C4 (houses in multiple occupation) of that Schedule."
and not being development comprised within any other Class.
The effect of the Article 4 Direction is to require a grant of planning permission to be obtained for development of the type to which it applies for all land within Harlow Council. Where planning permission is required, an application should be made to the Council; no fee is payable where an application for planning permission is required solely because of the effect of the Article 4 Direction.
It is intended that the Article 4 Direction will come into force on the 12th April 2021.

The start date of the period during which representations may be made to the Council regarding the making of the Article 4 Direction is 26th March 2020.
The period for making representations ends on 24 April 2020. Representations should arrive at the Council no later than 17:00pm.

The Council will take into account any representations that are received by 17:00pm on 24th April 2020 in deciding whether to confirm the making of the Article 4 Direction.
