Rape claim teen 'consented', court hears

A teenager who claimed she was raped in a Borehamwood car park consented to sex both on that night and on an earlier occasion, a jury was told this morning.

The 18-year-old told Ertin Altun she wanted to have sex with him and pulled down her leggings as they kissed in the early hours of the morning, he said.

Giving evidence at St Albans crown court Mr Altun, who is now 24, said he met the woman first through the Faceparty website.

He said they arranged to meet in June 2007 and he picked her up from her home in Borehamwood in his father’s BMW.

“She got in the car. I asked where she wanted to go. She directed me to a pub in Hatfield. We both had a glass of wine. We sat on chairs and she asked me to move to sofas in the corner. We were kissing, snogging and hugging,” he said.

After being in the pub for an hour-and-a-half, he said they went back to his car and she directed him to a council car park, in Elstree Way. “We started kissing, snogging and holding hands. She asked me to lay next to her. I put her seat back so there was enough space for both of us. I moved over to her side.

“She asked me if we could have sex. She performed oral sex on me and we had consensual sex.”

He said they lost contact for a few months because she went away to the west country, but in late September she sent him a message on Faceparty and they agreed to meet up.

On the night of the alleged rape he said he finished work at his brother’s shop in Shoreditch and went to a friend’s birthday part at the Istanbul restaurant, in Edmonton.

He said he was driving to the McDonald’s on the A10 in Enfield when she contacted him and he agreed to meet her at her home.

He said: “She came out and gave me a kiss. I asked where she wanted to go and she directed me to a car park.”

Asked by his barrister Brian Argyle if she was intoxicated, he replied: “She looked okay.”

He said in the car park they talked about her family problems while holding hands. They then began kissing and snogging, he said.

Then she pushed her seat back, pulled down her leggings and said: “I want to have sex.”

Mr Altun said she again performed oral sex on him and he then got on top of her and they had sex.

He denied that she had repeatedly said: “No.”

The girl, who is now 19 and had spent the night clubbing in Watford, claims she had to kick him off her. She said she told him via text message: “I said ‘No’ to you and you didn’t stop. That is so disrespectful.”

Mr Altun of Malvern Road, Tottenham, pleads not guilty to raping the girl on 6 October last year.

The trial continues.
