A composting company has been given an extra three weeks despite being told to submit a planning application by the end of last month.

In June Reviva Composting Limited, a site based in Elstree Hill South, was given an odour abatement notice served by Hertsmere Borough Council following an escalation in complaints by residents as far as Harrow.

The company had to apply for planning permission by no later than September 30 but now Hertsmere Borough Council has given the company an extra three weeks.

One resident Myk Tucker, of Hillersdon Avenue, Edgware, said: "By not submitted the application by the given date Reviva is in contempt of court.

"They have not done what they were supposed to have done in the allocated time. A lot of people have been affected by the smell of the compost site.

"Reviva have breached their court order. I do not understand why they are allowed an extra 21 days.

"I use the gym in the Centennial Business Park in Elstree and the smell is horrendous. Most of the businesses in the park have not been given the chance to object.

"We were all expecting to see a planning application submitted in September. During the court proceedings they offered to enclose the entire site to deal with the odour but that would mean building on Green Belt land."

More than 80 households complained to the council about odours from the site and in November last year they were receiving calls from residents on a daily basis.

The varied notice also required Reviva to comply with the Odour Management Plan for the site, which was submitted to the Environment Agency in accordance with the environmental permit.

The also contributed £3,750 towards the council's legal costs.

Speaking on behalf of Hertsmere Borough Council Keely James said: "We have been in discussion with Reviva and are allowing them an additional three weeks in which to get an application in to us."
